Key requirements

Three questions decide the path, in order:

• Is the decision reviewable, and by whom? Most onshore refusals and sponsored applications carry review rights at the Administrative Review Tribunal; many offshore non-sponsored refusals do not
• What is the deadline? ART deadlines are short — commonly 21 to 28 days from notification depending on decision type, and they are not extendable
• What did the refusal actually turn on? The decision record tells you whether the problem was evidence (fixable), criteria (sometimes fixable), or integrity findings such as PIC 4020 (serious, long shadows )

3. Decide between review, re-application, and a change of pathway on the merits
4. If reviewing: lodge in time, then build the evidence case — ART hearings currently run many months to years from lodgement, and time in the queue is itself a strategic factor

FAQ

My visa has just been refused. What should I do first? Note the date on the notification letter. Review deadlines run from notification and are strictly applied.

Will a refusal affect future applications? A disclosed and properly explained refusal is manageable in most categories. Concealing one is far more damaging: its discovery leads to integrity findings that outlast the original refusal.
